General Privacy Policy

Mobile Motion Lab Kft. processes your personal data in accordance with Regulation 2016/679 of the European Parliament and of the Council on the General Data Protection Regulation (hereinafter: GDPR) as follows:

 

Definitions (under GDPR)

Personal data: any information relating to an identified or identifiable natural person (“data subject”); an identifiable natural person is one who can be identified, directly or indirectly, in particular by reference to an identifier such as a name, number, location data, an online identifier or to one or more factors specific to the physical, physiological, genetic, mental, economic, cultural or social identity of that natural person.

Health data: personal data relating to the physical or mental health of a natural person, including data relating to health services provided to a natural person which contain information about the health of the natural person.

Data processing: any operation or set of operations which is performed upon personal data or on sets of personal data, whether or not by automated means, such as collection, recording, organisation, structuring, storage, adaptation or alteration, retrieval, consultation, use, disclosure by transmission, dissemination or otherwise making available, alignment or combination, restriction, erasure or destruction.

Controller: the natural or legal person, public authority, agency or any other body which, alone or jointly with others, determines the purposes and means of the processing of personal data; where the purposes and means of the processing are determined by Union or Member State law, the controller or the specific criteria for the designation of the controller may also be determined by Union or Member State law.

Data subject’s consent: a freely given, specific, informed and unambiguous indication of the data subject’s wishes by which he or she signifies, by a statement or by an act unambiguously expressing his or her consent, that he or she gives his or her consent to the processing of personal data concerning him or her.

 

What personal data do we process? What is the purpose of our processing?

We process personal data (name, place and date of birth, mother’s name, address, e-mail, telephone number) and sensitive personal data relating to your health condition in the course of our operations . The personal data you provide will be used for identification purposes, to establish a contractual relationship, to perform the contract, for billing purposes and for future communications

 

Which organisation processes your personal data?

Your personal data are processed by Mobile Motion Lab Kft. (registered office: 1038 Budapest, Blanka köz 4/c.); company registration number: 01 09 377905; tax number: 26398756; statistical number: 26398756-9604-113-01).

We do not transfer your data to third countries.

 

What is the legal basis for processing your data?

We process your data on the basis of your explicit consent (Articles 6(1)(a) and 9(2)(a) GDPR). This also applies to data that you have disclosed with your explicit consent (Article 9(2)(e) GDPR).

In certain cases, personal data are necessary for the establishment of a contractual relationship for the use of the service and for the performance of the contract pursuant to Article 6(1)(b) GDPR, and information relating to billing is required by the controller to comply with legal obligations pursuant to Article 6(1)(c) GDPR.

 

How long do we keep your data?

If the processing is based on the data subject’s consent, we will retain the personal data until it is withdrawn.

We will keep the data necessary for the performance of the service contract until the performance of the contract or until the limitation period for legal claims arising from it has expired, but for a maximum of 5 years.

Because billing data is generated when you use our service, we will keep your data for 8 years due to accounting rules on the retention of supporting documents.

The retention period may be extended for a further 3 years for legitimate interest (Article 6(1)(f) GDPR).

 

What are your rights in relation to data processing?

Right of access: you can request information about what data we process, for what purpose, for how long, where the data originate from and to whom we disclose it.

Correction: if your details have changed or have been incorrectly recorded, you can ask for them to be corrected, corrected or clarified.

Deletion: you can request that we delete your data we have processed in the cases specified by law.

Restriction of processing: you can request that we restrict processing in the cases specified by law.

Objecting to processing: where we process your data on the basis of legitimate interests as set out above, you may object separately to the processing on the basis of those legitimate interests. You may also object to processing for profiling purposes.

Data portability: you can request the portability of your data by filling in a data portability request form, which is exercised by us to disclose your data to you as defined by law or to another designated organisation upon your specific request and authorisation.

What is the technical background to the processing of personal data?

We store your personal data in the cloud and on our own central server. When you use our website, we use small programs called cookies on your device to use your browsing and location data to learn about your interests, personalise and improve your user experience, send you personalised offers and advertisements. No automated decision-making will take place in relation to your personal data.

In the event of a data breach, we will take the necessary steps to protect your data in accordance with the law and notify you of the facts and consequences of the breach.

 

Where to lodge a complaint in case of infringement?
